Terms of Use

These terms are an agreement between you and [LEGAL ENTITY NAME] (“Ascend”, “we”, “us”) for your use of the Ascend iPhone app and the ascendgym.online website. By creating an account or using Ascend, you agree to them. If you don’t agree, please don’t use Ascend.

1. Who can use Ascend

• You must be at least 16 years old.
• You’re responsible for keeping your login details secure and for activity on your account.
• One person per account. Accounts are personal and can’t be sold or transferred.

2. Train safely

Ascend is a training log and a game — it is not medical advice. Ranks, standards and goals are for motivation, not instructions to lift a particular weight. Lift within your ability, use proper technique and spotters, and speak to a doctor before starting a new training programme, especially if you have a medical condition or injury. You use Ascend at your own risk.

3. Ranks, fair play and your content

• Ranks, XP, levels, titles, achievements and clan scores have no monetary value and can’t be exchanged for money.
• Please log your real training. We may review accounts that our systems flag as unrealistic, and reset ranks, remove titles or suspend accounts that falsify workouts or try to exploit the game.
• You keep ownership of what you create — usernames, clan names, photos, notes and feedback. You give us a licence to store and display it as needed to run Ascend (for example, showing your username and avatar to clan members).
• Don’t upload anything illegal, hateful, sexually explicit, harassing or that you don’t have the right to share, and don’t use offensive usernames or clan names. We may remove content or accounts that break these rules.
• Don’t attempt to access other people’s data, reverse-engineer, overload or disrupt the service.

4. Ascend Plus subscriptions

Ascend is free to use. Ascend Plus is an optional subscription that adds extra features.

• Plans: €4.99 per month or €34.99 per year (prices include VAT and may vary by country; the price shown in the App Store at purchase applies).
• Billing: payment is charged to your Apple ID account when you confirm the purchase. Subscriptions are sold and billed by Apple.
• Auto-renewal: your subscription renews automatically at the end of each period at the same price unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within the 24 hours before the period ends.
• Free trial: the annual plan may include a 7-day free trial for eligible new subscribers. Unless you cancel at least 24 hours before the trial ends, it converts automatically into a paid annual subscription and you’ll be charged the annual price. Any unused part of a free trial is forfeited when you buy a subscription.
• Cancelling: manage or cancel at any time in your iPhone’s Settings → [your name] → Subscriptions, or in the App Store under your account. Cancelling stops future renewals; you keep Plus until the end of the period you’ve paid for. Deleting the app or your Ascend account does not cancel an App Store subscription.
• Refunds: all payments are handled by Apple, so refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com. We can’t issue refunds ourselves.
• Price changes: if the price changes, Apple will notify you in advance and, where required, ask for your consent before renewing at the new price.
• Restore purchases: if you reinstall or change device, use “Restore Purchases” in Settings with the same Apple ID.

5. Themes

Rank themes are unlocked only by reaching that rank and can’t be purchased. Individual themes (€0.99) are coming soon; when available they’ll be one-time App Store purchases tied to your Apple ID.

6. Changes to Ascend

Ascend is evolving. We may add, change or remove features, rebalance ranks, standards, XP or rewards to keep the game fair, and we’ll try to give notice of significant changes. If we remove a core Ascend Plus feature during a paid period, you can contact us.

7. Ending your account

You can delete your account at any time in the app (Settings). This permanently deletes your data as described in our Privacy Policy. We may suspend or close accounts that seriously or repeatedly break these terms.

8. Liability

We provide Ascend “as is” and can’t promise it will always be available or error-free. To the extent the law allows, we aren’t liable for indirect or consequential losses, or for injury resulting from training decisions you make. Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or any other liability that can’t be limited by law, and nothing affects your statutory rights as a consumer.

9. Apple

These terms are between you and Ascend, not Apple. Apple’s standard Licensed Application End User License Agreement also applies to your use of the app. Apple has no obligation to provide maintenance or support for Ascend and is not responsible for claims relating to it.

10. Governing law

These terms are governed by the laws of Ireland. If you live in the EU, you also benefit from the mandatory consumer protections of your country of residence.

11. Changes to these terms

We may update these terms. If changes are significant, we’ll tell you in the app before they take effect. Continuing to use Ascend after that means you accept the new terms.
